Dual Agency is the common practice of one real estate agent or broker attempting to represent both the buyer and the seller in the same transaction. It is our belief that dual agency harms both buyers and sellers in exchange for rewarding the real estate brokerage with more closings and higher profits.
Depending on the laws in your state, you may discover during your transaction, that “your” agent may actually be working and negotiating for the seller, not you, the buyer. The best way to be certain your best interests are being pursued and protected is to sign a buyer agency agreement with a trained buyer’s agent, which establishes client-level services and clearly spells out how you will be represented.
The question is asked: “How can a buyer’s [agent]... maintain complete loyalty to their buyer if he or she also owes complete loyalty to the seller? Obviously, they can’t.” - National Association of REALTORS Real Estate Buyer’s Agent Council (REBAC)
The National Association of Realtors (NAR) also states that “two-thirds of both buyers and sellers only contact one agent before choosing an agent to work with.”
They go on to divulge that only 30% of buyers receive proper disclosure of who their buyer’s agent really represents at their first meeting. Many buyers don’t find out that “their” real estate agent actually represents the seller until it is difficult or impossible to find their own TRUE representation.
