Unfortunately, some traditional agents pretend to be Exclusive Buyer Agents.
An Exclusive Buyer’s Agent works for a company that takes no listings and never represents sellers. The broker and the agents in the company represent buyers ONLY in all transactions where hired for representation.
Confusion in the marketplace is made worse by buyer agency agreements in a handful of states with titles such as “Exclusive Buyer Agency Agreement” or “Exclusive Buyer-Brokerage Agreement.” An agent may falsely tell you that signing such an agreement makes them an Exclusive Buyer Agent. It does not. It merely binds you to working with that agent exclusively. Many of these (so-called) Exclusive Buyer Agency Agreements include clauses that legally sign away the buyer’s right to full representation. We don’t think you should do that.
Exclusive Buyer Agents do not exist in every market. Your next best option is a single agent... One who will agree to represent you, and only you in your transaction. If a conflict of interest arises, the agent will not ask you to agree to limited or dual agency, but will let you out of the contract to seek representation from an agent without the conflict of interest.
Even though Single Agents will never represent a buyer and a seller in the same transaction, a single agent that works for a company that takes listings is not an Exclusive Buyer’s Agent.
